What information a cancellation letter must contain
A cancellation is a unilateral declaration of intent requiring receipt. It only takes effect once it reaches your contract partner — and it must be unambiguous. It should always include:
- Your full name and address
- The name and address of your contract partner
- Your contract, customer or membership number
- The word "cancel" (kündige) — unambiguous, not conditional
- The desired cancellation date, or "at the earliest possible date"
- Date and signature
- A request for written confirmation of the cancellation, stating the end date
Never phrase it as "I would like to cancel" or "I hereby request cancellation". Neither of those is a cancellation — they are merely statements of intent.

Dear Sir or Madam,
I hereby cancel the above-mentioned contract with proper notice, effective at the earliest possible date. Please confirm in writing that you have received this cancellation, together with the date on which the contract ends.
Should cancellation not be possible on the date stated, I hereby give notice for the next possible date thereafter.

The decisive factor is always the contract itself or the applicable statutory rule. Before sending, check whether the deadline runs up to a particular date or within a period.
Receipt: the most common point of dispute
What counts is not the postmark, but receipt by the recipient. A letter is deemed received once it has entered the recipient's sphere of control in such a way that, under normal circumstances, they could be expected to take notice of it — for businesses, that is usually the working day after it is posted.
Practical safeguards:
- Send early; allow at least a week's buffer before the deadline.
- Keep a copy of the exact document you sent.
- Document the date of sending — for example via the saved PDF of the mailing.
- For higher-value disputes, also consider registered mail with return receipt (Einschreiben mit Rückschein).
Written form for employment relationships
For terminating an employment relationship, § 623 of the German Civil Code (BGB) requires the written form: the original needs a handwritten signature — a scan or an email is not sufficient. Here too, a printed, signed letter is the safe route.
What happens after sending
- Wait for confirmation from your contract partner — usually within two weeks.
- If it doesn't arrive, follow up in writing and refer to the date of sending.
- Only stop direct debits once the termination has been confirmed.
- Keep the confirmation at least until the end of the limitation period.
